Terms of Service

These Terms govern macunfilm subscriptions, downloads, customer accounts and use of the macunfilm plugin for DaVinci Resolve.

Essential terms

A paid subscription grants one person a limited licence for one device. Monthly and annual plans renew automatically until cancelled. An active licence is checked when the plugin starts and periodically while DaVinci Resolve remains open. Mandatory consumer rights always remain unaffected.

1. Parties and acceptance

The contracting party and software rights holder is Rogelio Silio, trading under the product and business name macunfilm, Suzöl 28, 7543 Lavin, Switzerland. macunfilm is not currently a separate legal entity.

You accept these Terms when you actively confirm them before checkout, order a subscription, download, install, activate or use macunfilm. If you do not agree, do not purchase, install or use the product. You must have legal capacity to enter the contract; consumers under the applicable age require permission from a parent or legal guardian.

The Privacy Policy governs personal-data processing. The offer and Stripe Checkout identify the selected billing interval, price, currency and taxes. For conflicting commercial details, the checkout confirmation for the specific order prevails, while mandatory law always prevails over these Terms.

2. Product and service

macunfilm is a film emulation plugin for DaVinci Resolve. It includes the plugin, film profiles, installer, documentation, website account, licence service and updates made available for the subscribed product. The product ID is com.macunfilm.macunfilm.

Image processing takes place locally on the user's computer. macunfilm does not upload footage as part of ordinary plugin operation.

The current release is for supported macOS and DaVinci Resolve environments described on the installation page. Future Windows or other platform versions are included only if expressly stated in the relevant offer.

3. Licence and permitted use

While the subscription and licence remain active, macunfilm grants the subscriber a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable right to install and use the subscribed version on one authorised device. Commercial film and video work by the licence holder is permitted.

A separate licence is required for each additional device and for each additional person using the software. A licence may not be shared as a floating team licence. Ownership of the software, profile data, brand or documentation is not transferred.

3.1 Restrictions

You must not:

  • share, publish, sell, rent, lend or transfer a licence key, account, installer or plugin copy;
  • circumvent, disable, probe or interfere with licensing, device binding, encryption, watermarking or other protection;
  • extract, decrypt, convert, record or distribute the compiled profile package, film profiles, LUT-like data or protected assets as standalone material;
  • modify, decompile, disassemble or reverse engineer the software except to the limited extent that mandatory law expressly permits this, including lawful interoperability work;
  • remove legal notices or represent macunfilm or its profiles as your own product;
  • provide access to the plugin as a hosted service, resale service or shared facility without written permission.

Technically necessary backup copies are permitted provided that they remain protected, are not used to exceed the licence and are deleted when the licence ends.

4. Licence key and customer account

You are responsible for keeping the activation key, email security codes and account session confidential. The licence key activates the plugin only and is not accepted as a customer-account or billing credential. Account access requires a one-time code sent to the Stripe billing email, and sensitive billing or device actions require recent verification.

Notify [email protected] promptly if a key is lost, disclosed or used without permission. macunfilm may revoke and replace a compromised key after reasonable verification. Never place a full key in a public post, screenshot or ordinary bug report.

5. Delivery, installation and activation

The current installer is available from the official macunfilm website. A valid licence and subscription are required to use macunfilm. After successful payment, the licence key is displayed on the success page and sent to the Stripe billing email. The protected account is accessed separately through that billing email for device and subscription management. Delivery is electronic.

One device is bound when a valid licence is first checked. macunfilm validates the licence at the first plugin request after each DaVinci Resolve start and periodically while Resolve remains open. A temporary connection failure after a successful validation may receive a technical grace period of no more than 30 minutes; an explicit inactive, cancelled, unpaid, past-due or payment-failed response receives no such grace period.

If validation cannot be completed, the licence is inactive, payment has failed, the subscription has ended or the key belongs to another device, macunfilm may withhold its effects and apply a visible watermark and brighter protective image treatment. Disabling or removing the macunfilm node removes both the plugin effects and the protection from the image.

The verified account holder may deactivate the currently authorised device for a legitimate permanent computer change. The next successful validation binds the active licence to the new device. A 24-hour security period between customer-initiated changes and support verification for exceptional cases may apply; the one-device limit remains unchanged.

If a subscription ends and the customer later purchases a new subscription, the new licence is a separate entitlement and can replace the previously stored local key. Inactive historic licences remain visible only as account records and do not reactivate the plugin.

6. Subscriptions, renewal and cancellation

macunfilm is currently offered as a monthly or annual subscription. The selected plan starts when Stripe confirms the subscription as active. It renews automatically for the same billing interval until cancelled, at the price and on the renewal terms shown in Stripe Checkout or communicated before a change takes effect.

You can manage or cancel through the macunfilm Account, which opens the Stripe customer portal. Unless mandatory law or an express offer states otherwise, cancellation takes effect at the end of the current paid billing period. Access remains active until that date and no further renewal charge is made after the cancellation becomes effective.

When a payment fails, becomes past due or remains unpaid, the licence may be disabled immediately on the next validation until Stripe confirms successful payment. No offline session started after an unsuccessful validation is authorised.

Changing between monthly and annual plans may require cancelling the current subscription and purchasing the other plan. Any proration or credit applies only where displayed by Stripe or required by law.

7. Prices, payment, taxes and confirmation

Prices and billing intervals are presented before payment. Stripe displays the final amount, currency and applicable tax information and processes the payment under its own terms. macunfilm does not store complete card details.

The order is complete only when Stripe confirms successful checkout. macunfilm then provides an electronic confirmation and licence information. You are responsible for accurate billing and contact information.

8. Digital delivery, withdrawal and refunds

By requesting checkout, you ask macunfilm to provide the digital licence, account and download immediately after payment. Where applicable consumer law provides a withdrawal right that can expire when digital supply begins, you expressly request immediate performance and acknowledge that effect through the checkout confirmation.

Fees already paid for a current billing period are non-refundable and are not prorated solely because the subscription is cancelled during that period, except where a refund is required by mandatory law or expressly confirmed by macunfilm. Access continues until the end of that paid period. Swiss law does not provide a general statutory withdrawal period for ordinary online purchases. This policy does not limit mandatory rights relating to defective performance, incorrect charges or consumer protection in your country. Refund requests required by law should be sent promptly to [email protected] with the relevant order information.

9. Updates and product changes

An active subscription includes updates released for the subscribed macunfilm product. Updates may add, modify or remove features, profiles, controls, compatibility or technical requirements. No particular future feature is promised unless expressly included in the offer.

macunfilm may issue security or compatibility updates and may require a reasonably current version for licence validation. Material reductions affecting an already paid period remain subject to mandatory law.

10. Support and user material

Support is provided at [email protected] on a reasonable-efforts basis. No fixed response time or production deadline is guaranteed unless separately agreed.

You retain rights in footage, projects, logs and other material you voluntarily provide. You grant macunfilm only the limited right needed to receive, reproduce and analyse that material for your support request. You must have authority to share it and should remove unnecessary personal, client or confidential information.

Feedback and suggestions may be used without payment to improve macunfilm, but footage, a testimonial, your name, image or company identity will not be used for marketing without a separate written release.

11. Third-party software and services

DaVinci Resolve, macOS, Stripe, Cloudflare, Resend and other third-party components or services are governed by their respective terms. Open-source or third-party software included in macunfilm remains subject to its applicable licence notices. macunfilm does not control third-party availability or changes.

12. Suspension and termination

macunfilm may suspend or terminate a licence for non-payment, material breach, key sharing, fraudulent use, circumvention of protection, attacks on the service or conduct that creates a genuine security or legal risk. Where reasonable, an opportunity to correct the issue will be provided; urgent security action may be immediate.

When access ends, you must stop using the software and delete installer and plugin copies except for inaccessible backup copies retained only until normal rotation. Terms concerning intellectual property, confidentiality, liability, records and disputes continue where their purpose requires.

13. Warranty

macunfilm is provided with the care reasonably expected of a professional software product, but creative results depend on footage, color management, host settings, hardware and the user's grading decisions. Except for mandatory rights and express commitments, macunfilm does not guarantee uninterrupted or error-free operation, compatibility with every host configuration or a particular artistic result.

Color workflows and computer setups vary. Keep current project and media backups, validate important grades before delivery and avoid making any single plugin the sole solution for irreplaceable material.

14. Liability

To the extent permitted by law, macunfilm is not liable for damage caused by slight negligence, indirect or consequential loss, lost profit, business interruption, or loss of footage, projects or data where the user failed to maintain reasonable backups. For paid services, aggregate liability for other claims is limited to the amount paid for the affected subscription during the twelve months preceding the event.

Nothing in these Terms excludes or limits liability for intent, gross negligence, death or personal injury, fraudulent conduct, or any warranty or liability that mandatory law does not permit to be excluded or limited.

15. Events outside reasonable control

macunfilm is not responsible for delay or failure caused by events outside reasonable control, including internet or cloud-provider outages, payment-network failures, public-authority action, natural disasters, war, strikes or widespread platform incidents. Obligations resume when reasonably possible.

16. Changes to these Terms

macunfilm may update these Terms for legal, security, technical or product reasons. The edition date identifies the current version. Material changes affecting an active paid relationship will be communicated reasonably in advance where practicable. Changes to price or renewal conditions apply only as notified and subject to cancellation and mandatory rights.

17. Governing law and disputes

These Terms and the contractual relationship are governed by Swiss law, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. The courts at the provider's domicile in the Canton of Graubünden have jurisdiction where legally permitted.

Mandatory consumer-protection rules and mandatory jurisdictions at the customer's residence remain unaffected. Please contact [email protected] first so that a problem can be reviewed directly.

18. Miscellaneous and contact

If one provision is invalid, the remainder remains effective and the applicable legal rule replaces the invalid part. You may not transfer the licence or contract without written consent. macunfilm may transfer the business to a legal successor provided customer rights and data safeguards remain protected.

The English version is the current authoritative website version. Future translations are for convenience unless mandatory law requires otherwise.
